Abstract

Nowadays, the fake news are the biggest problem faced by a connected world. The spread of information is fast and, because of it, these false reports have been changing the personal and juridical relations. Therefore, the law n. 12.965/14, known as “The Civil Milestone of the Internet”, talked about principles, guarantees, rights and obligations that regulate the use of internet in Brazil. In this context, this paper analyses the civil responsibility of internet application providers in face of fake news, provided in article 19 of that law, advocating that the analysis of the truth of online publication should be done by the judiciary, harmonizing fundamental rights.
